I have had a dream about myself and this Judge and I remember we were on a country road in .... well at an intersection and we rode to the house an old country house like for ranch hands or a farm with many workers and this was the place for all of the Jeffes but there were no Jeffes and this was before we coined Shamsie as "The Boss of Bosses" (that story another day). Manuel Bañales struck a Robstown man with mental disabilities who was crossing the street near Corpus Christi City Hall.&lt;/p&gt; &lt;p&gt;Bañales was not ticketed for the incident and the pedestrian, Francisco "Frank" Peña, then 31, was found at fault. He was taken to Memorial Medical Center with cuts, scrapes and a broken leg. &lt;/p&gt; &lt;p&gt;Bañales and his lawyer, Ron Barroso, did not return phone calls Thursday. &lt;/p&gt; &lt;p&gt;The Caller-Times filed a public records request with the Corpus Christi Police Department on June 9 seeking a police accident report and other documents related to the incident. The police department wasn't able to fill the request because, under department guidelines, traffic accident reports are purged after two years, according to police.&lt;/p&gt; &lt;p&gt;An Aug. 20, 1990, police report obtained by the Caller-Times through other means Thursday afternoon and verified by Mayor Henry Garrett, who was police chief at the time, shows that Bañales was traveling west on Leopard Street at 7:20 p.m. when Peña crossed the street, without the benefit of a crosswalk. The report says Bañales braked and swerved.&lt;/p&gt; &lt;p&gt;"This is an accident report that we generated at the police department at the time," Garrett said. "It's the real thing. It looks like the pedestrian was crossing at the middle of the block. To look at this diagram, I wouldn't see that a ticket would have been issued. By the diagram and what's in the report, the violation was the pedestrian."&lt;/p&gt; &lt;p&gt;Peña's father, Ramon Peña, 74, gave a different version of events Thursday morning. He was not there to witness the collision but talked to witnesses shortly after.&lt;/p&gt; &lt;p&gt;Frank Peña was waiting for a bus at the corner of Leopard and Staples when he decided to cross the street to a convenience store to get a soda, his father said.&lt;/p&gt; &lt;p&gt;"He looked both ways and here came the judge," Ramon Pena said. &lt;/p&gt; &lt;p&gt;City Councilman Mike Hummell, an attorney, who was serving as the assigned prosecutor in Bañales' court at the time of the accident, went to the scene shortly after it happened. &lt;/p&gt; &lt;p&gt;He could not remember if Bañales had called him or if he happened upon the accident on his way home. &lt;/p&gt; &lt;p&gt;"The only thing I recall is the guy had a Big Red," Hummell said. "When I got there, there was Big Red all over the car and at first glance it was a scary thing. Looking closer it was just a soft drink."&lt;/p&gt; &lt;p&gt;Ramon Peña said he had difficulty finding a lawyer to take his son's case. "I saw a lawyer every day on TV, Mike Butler. At first he refused to take the case but then he decided to."&lt;/p&gt; &lt;p&gt;Mike Butler, who now practices in San Antonio, did not return repeated phone calls this week. &lt;/p&gt; &lt;p&gt;But Jeffrey DeVillez, who was an investigator and insurance negotiator for Butler's law practice at the time, remembered the 1990 accident.&lt;/p&gt; &lt;p&gt;"They were accusing the kid and the kid's family was accusing Bañales, saying that he was not watching," DeVillez said. "He was a judge and the kid was (disabled). They couldn't put the kid on trial. They wanted to avoid that at all costs. So we asked for the total amount of the policy and said let's move on."&lt;/p&gt; &lt;p&gt;Ramon Peña said Bañales had a $100,000 insurance policy. This goes to Erics show and the morning show with Bob Jones and John Gifford. Y'all have really stepped it up.&lt;br /&gt;&lt;br /&gt;I want to touch on the interview that occured this morning. As an individual who lives outside Corpus, but works in Corpus, I certainly have an interest in the politics of the city and surrounding areas.&lt;br /&gt;&lt;br /&gt;I have heard of Michael Watts from time to time but I haven't had the opportunity to hear him speak live until this morning. Here is my take on him. First of all, I believe him to be a power hungry, self serving man who throws his money around to prove how important he is. This is just my gut instinct talking here. Having said that, I have learned to trust my gut over the years and I don't like what I am feeling about this guy.&lt;br /&gt;&lt;br /&gt;As far as Juan Garcia goes, I don't have a good feeling about him either. He wants to run on his military record and frankly I am getting a little tired of hearing that. They want to say that he was a Naval Aviator and spent 14 years in the Navy. So here are the questions I have. What kind of Naval Aviator was he? We know that he wasn't an enlisted aircrewman or a Naval Observer. So was he an NFO or a pilot? Why did he get out after 14 years? Six more years and he could of retired. Could it be that he was passed up for Commander? If that was the case, then he definitely wasn't the "pick of the litter" as far as the Navy was concerned. Come to think of it, I was a Naval Aviator for 19 years! Even though I was an Enlisted Aircrewman I was still a Naval Aviator. I was also in for 20 years and I have lived in this area for 10 years. Wouldn't that make me more qualified according to the Democrats? Also, his comments on the news about the Gene Seaman ads was a lame attempt at plausible deniability. He said that he hadn't heard those commecials and knows nothing about them. He also stated that he is running a clean campaign. What I say is, "B.S.!!" I ain't buying any of that. How could he not know. If he wants to play like he has been sheltered from all of that, then I can tell you right now that he is not the person you want to elect.&lt;br /&gt;&lt;br /&gt;Let me wrap this up with a comment from the illustrious Judge Schamze. He stated that Oliverez is clean of all the jail problems. He went on to say that it falls squarely on the shoulders of Sheriff Stutz. (excuse my spelling) This is another issue that I ain't buying. Looking at the conditions that I saw, these problems were well underway before Stutz arrived on the scene. It is funny what these democrats will say on a liberal station versus what they will say on 1440 KEYS.&lt;br /&gt;&lt;br /&gt;I have more but this is already long. They have a tendency to embellish their own achievements and tear down their opponent. State Rep. Vilma Luna announced Wednesday that she is resigning effective July 31. Democratic Party Chairman Alex Garcia and several others confirmed the resignation will be effective at the end of the month. "My constituents have seen me grow from a single woman to a married woman to the mother of two wonderful boys," she said at a press conference at her legislative office on Gollihar Road. "My family has been blessed many times over, and we tried to give back ... but it is time for my family and I to have more flexibility in our lives." Luna, D-Corpus Christi, was elected to the District 33 seat in 1993. Luna serves as vice chair of the House Appropriations Committee and also has served on the House Calendars and Ways and Means committees. She said the timing of her resignation was in the best interest of her constituents because it allows the election code process to be followed and for her successor to be elected in the regular November election and to serve a full term. Solomon Ortiz Jr. will seek her post, he said in a press release soon after Luna's announcement. "While I declined to seek the Democratic nomination earlier this year because I had no interest in challenging a sitting Democrat, today's announcement really does change things considerably," the press release from the Democratic Party chairman said. Danny Noyola Sr., former principal of Miller High School, was scheduled to announce his intent to run for Luna's position at noon. Luna said she has not made concrete plans about what she will do after she resigns.
