anyway Homero has been very diligent and even to a point of appearing fanatical and crazy but you guys know what we have known for quite sometime now. I have had a dream about myself and this Judge and I remember we were on a country road in .... well at an intersection and we rode to the house an old country house like for ranch hands or a farm with many workers and this was the place for all of the Jeffes but there were no Jeffes and this was before we coined Shamsie as "The Boss of Bosses" (that story another day). Well we (the Judge and I) we came to an intersection and our direction of travel alligned as we rode a basic bicycle each of us the same neither of us were advantaged and we entered into the House of the Jeffes and we went to the kitchen as I discuss the wrongs he could have corrected, the injustice he ignored and now I know why he was washing his hands and telling me everything is gonna be alright but I kept on watching him wash his hands as if they will never become clean and my hands were perfectly clean and to wash them in that sink would make them uncleanable or not the kind of clean we expect.

Bañales struck man in 1990 accident

Eighteen years ago, a gold Chrysler Fifth Avenue driven by District Judge J. Manuel Bañales struck a Robstown man with mental disabilities who was crossing the street near Corpus Christi City Hall.

Bañales was not ticketed for the incident and the pedestrian, Francisco "Frank" Peña, then 31, was found at fault. He was taken to Memorial Medical Center with cuts, scrapes and a broken leg.

Bañales and his lawyer, Ron Barroso, did not return phone calls Thursday.

The Caller-Times filed a public records request with the Corpus Christi Police Department on June 9 seeking a police accident report and other documents related to the incident. The police department wasn't able to fill the request because, under department guidelines, traffic accident reports are purged after two years, according to police.

An Aug. 20, 1990, police report obtained by the Caller-Times through other means Thursday afternoon and verified by Mayor Henry Garrett, who was police chief at the time, shows that Bañales was traveling west on Leopard Street at 7:20 p.m. when Peña crossed the street, without the benefit of a crosswalk. The report says Bañales braked and swerved.

"This is an accident report that we generated at the police department at the time," Garrett said. "It's the real thing. It looks like the pedestrian was crossing at the middle of the block. To look at this diagram, I wouldn't see that a ticket would have been issued. By the diagram and what's in the report, the violation was the pedestrian."

Peña's father, Ramon Peña, 74, gave a different version of events Thursday morning. He was not there to witness the collision but talked to witnesses shortly after.

Frank Peña was waiting for a bus at the corner of Leopard and Staples when he decided to cross the street to a convenience store to get a soda, his father said.

"He looked both ways and here came the judge," Ramon Pena said.

City Councilman Mike Hummell, an attorney, who was serving as the assigned prosecutor in Bañales' court at the time of the accident, went to the scene shortly after it happened.

He could not remember if Bañales had called him or if he happened upon the accident on his way home.

"The only thing I recall is the guy had a Big Red," Hummell said. "When I got there, there was Big Red all over the car and at first glance it was a scary thing. Looking closer it was just a soft drink."

Ramon Peña said he had difficulty finding a lawyer to take his son's case. "I saw a lawyer every day on TV, Mike Butler. At first he refused to take the case but then he decided to."

Mike Butler, who now practices in San Antonio, did not return repeated phone calls this week.

But Jeffrey DeVillez, who was an investigator and insurance negotiator for Butler's law practice at the time, remembered the 1990 accident.

"They were accusing the kid and the kid's family was accusing Bañales, saying that he was not watching," DeVillez said. "He was a judge and the kid was (disabled). They couldn't put the kid on trial. They wanted to avoid that at all costs. So we asked for the total amount of the policy and said let's move on."

Ramon Peña said Bañales had a $100,000 insurance policy. Lawyer's fees and hospital bills carved Frank Peña's share down to a little more than $47,000, Ramon Peña said.

"Frank, he's still limping today and he got a rod in his leg," Ramon Peña said.

Kudos to 1440 KEYS for the interviews they have had on the show in recent months. This goes to Erics show and the morning show with Bob Jones and John Gifford. Y'all have really stepped it up.

I want to touch on the interview that occured this morning. As an individual who lives outside Corpus, but works in Corpus, I certainly have an interest in the politics of the city and surrounding areas.

I have heard of Michael Watts from time to time but I haven't had the opportunity to hear him speak live until this morning. Here is my take on him. First of all, I believe him to be a power hungry, self serving man who throws his money around to prove how important he is. This is just my gut instinct talking here. Having said that, I have learned to trust my gut over the years and I don't like what I am feeling about this guy.

As far as Juan Garcia goes, I don't have a good feeling about him either. He wants to run on his military record and frankly I am getting a little tired of hearing that. They want to say that he was a Naval Aviator and spent 14 years in the Navy. So here are the questions I have. What kind of Naval Aviator was he? We know that he wasn't an enlisted aircrewman or a Naval Observer. So was he an NFO or a pilot? Why did he get out after 14 years? Six more years and he could of retired. Could it be that he was passed up for Commander? If that was the case, then he definitely wasn't the "pick of the litter" as far as the Navy was concerned. Come to think of it, I was a Naval Aviator for 19 years! Even though I was an Enlisted Aircrewman I was still a Naval Aviator. I was also in for 20 years and I have lived in this area for 10 years. Wouldn't that make me more qualified according to the Democrats? Also, his comments on the news about the Gene Seaman ads was a lame attempt at plausible deniability. He said that he hadn't heard those commecials and knows nothing about them. He also stated that he is running a clean campaign. What I say is, "B.S.!!" I ain't buying any of that. How could he not know. If he wants to play like he has been sheltered from all of that, then I can tell you right now that he is not the person you want to elect.

Let me wrap this up with a comment from the illustrious Judge Schamze. He stated that Oliverez is clean of all the jail problems. He went on to say that it falls squarely on the shoulders of Sheriff Stutz. (excuse my spelling) This is another issue that I ain't buying. Looking at the conditions that I saw, these problems were well underway before Stutz arrived on the scene. It is funny what these democrats will say on a liberal station versus what they will say on 1440 KEYS.

I have more but this is already long. I'm wondering in anyone else feels a little uneasy about some of these people.

I have stated stated and will state until the day I croak STUTZ is being made a scapegoat by the Damocrats and Oliverez and she could be getting a huge payola for her effort to take the heat.

I agree on your analysis of the other people mentioned above. especially about leaving the Navy after being passed over for Cdr. Politics does pay well for former Navy Pilots. ""Right Duke"".

is to not pay too much attention to the ads. They have a tendency to embellish their own achievements and tear down their opponent. I would look at their record and see if which one was more in line with my line of thinking and also who their money backers were and then go from there.

But, then the probability of them getting drunk on their power and caving in to special interest and not representing your interest is more likely than not.

I know plenty of guys who saw a whole lot more action than he did in The Gulf and they don''t trade on it. Interesting thing that Juan''s last mailing (yesterday) made no mention of the Gulf War. Makes me think he may have fudged on that claim.
As to why he got out of the Navy after 14 years -- that would be an excellent question to ask him in an open forum.

Shamsie gives Larry the O an exemption on blame for the jail problems -- what an arrogant sob. Shamsie was the guy who sucked up to Al Sharpton -- got no use for that moron.

As far as being an effective State Rep.goes,does it really make any difference what either Seaman or Garcia did in the service or why they got out? Every candidate embellishes on their accomplishments and experience when they''re on the campaign trail,don''t they?..so why should this race be any different?

IMO,what voters SHOULD be doing is informing themselves on the issues and forcing their candidates to explain their positions on them,instead of being suckered by negative ads.There''s nothing that strikes fear into a politician like an informed voter.Seaman''s been in office nine years,and what has he accomplished?..not much.He''s been a steady,reliable vote for Tom Craddick..he helped put redistricting ahead of school finance on the Legislative agenda..he was part of six special sessions on school finance that ultimately produced a bill that was flawed at best and garbage at worst..basically,he shows up,votes with the Repub majority and goes home.You''d think after nine years in Austin,he''d have more clout than he does,which is next to none.

The way I see it,Garcia couldn''t do any worse,and you''re not getting much out of Seaman anyway,so why not take a vote out of Craddick''s pocket and bring some new blood to Austin in one fell swoop?

I agree with you, there has been precious little on issues coming out of either camp. As it stand now I am writing in our caped crusader from Leopard street or leaving the race blank.

I would dearly like a ""none of the above option on the ballot."" The two party system is failing us. Diet Coke or Diet Pepsi, you get your choice; neither has anything to offer as far as substance. We need something to get candidates talking about REAL issues that effect us all....not this see how low each of the candidates can go to hold onto a job that pays less per year than a high school kid working at McDonalds.

All this pilot ego trip too is a complete waste. I don’t care if they both drove their daddy''s pickup into an abatement because they were drinking and getting serviced by one of Leopard Street''s finest.

What makes them more qualified than Curmudgeon? At least with Curm you can count on the brutal entertaining truth.

This is what the crappy Times had reported. State Rep. Vilma Luna announced Wednesday that she is resigning effective July 31. Democratic Party Chairman Alex Garcia and several others confirmed the resignation will be effective at the end of the month. "My constituents have seen me grow from a single woman to a married woman to the mother of two wonderful boys," she said at a press conference at her legislative office on Gollihar Road. "My family has been blessed many times over, and we tried to give back ... but it is time for my family and I to have more flexibility in our lives." Luna, D-Corpus Christi, was elected to the District 33 seat in 1993. Luna serves as vice chair of the House Appropriations Committee and also has served on the House Calendars and Ways and Means committees. She said the timing of her resignation was in the best interest of her constituents because it allows the election code process to be followed and for her successor to be elected in the regular November election and to serve a full term. Solomon Ortiz Jr. will seek her post, he said in a press release soon after Luna's announcement. "While I declined to seek the Democratic nomination earlier this year because I had no interest in challenging a sitting Democrat, today's announcement really does change things considerably," the press release from the Democratic Party chairman said. Danny Noyola Sr., former principal of Miller High School, was scheduled to announce his intent to run for Luna's position at noon. Luna said she has not made concrete plans about what she will do after she resigns. It is unclear whether she will remain in Corpus Christi.

Mrs. Luna was a okay Democrat she kept moving right in her time in the Texas House. A lot of Democrats were angry with a lot of desicions she was making and wanted Ortiz Jr. to run, now I guess they got their wish.

I don't think it was re-drawn...the DeLay mess was for congressional seats. I don't think Nueces county's state seats were affected by the DeLay process. From what I understand, she's announcing now. Not being there, I can't attend.

Well..it seems the words hadn't even gotten out of Luna's mouth yet,and already the buzzards started circling.Solomon "Son of Sol" Ortiz,Jr. and Danny Noyola have announced they're running for her seat,and there may be a couple more crawling out of the woodwork.
About the best thing you can say for "Son of Sol" is that he's smarter and more articulate than his old man,but then again..isn't everybody? As for Noyola,he's mellowed his race mongering since leaving the West Oso ISD for CCISD,but the leopard never really changes it's spots.
My guess is there'll probably be one or two more throw their hats into the ring,which will have local hispanic Democrats sniping among themselves,much like they did when Pompadour Pete Alvarez got into that mud slinging match with Jimmy Rodriguez.

First of all why do female Judges who are married (especially to prominent leaders of our community) not go by their married last name?

Next, it must be mentioned so with the inference of the Hassette / Shamsie relationship to the jail photos one deductively must check into the counterpart (CCCT) and the relationship to Judge Hassette.
